Terms of Service

Please read these terms carefully before using the eProperties platform.

Acceptance of Terms

These Terms of Service ("Terms") constitute a legally binding agreement between you ("User", "you") and E-Land Ltd. ("E-Land", "we", "our", "us"), governing your access to and use of the eProperties platform, website, and all related services.

By registering an account, accessing, or otherwise using any part of the eProperties platform, you confirm that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you do not agree, you must cease use of the platform immediately.

We reserve the right to amend these Terms at any time. Continued use of the platform after changes are published constitutes your acceptance of the revised Terms. Significant changes will be notified via email or in-app notification.

Definitions

Throughout these Terms, the following definitions apply:

  • "Platform" — the eProperties web application, mobile applications, APIs, and all associated services operated by E-Land Ltd.
  • "User" — any individual or entity that registers for or accesses the Platform.
  • "Listing" — any land or property advertisement, offer, or record published on the Platform.
  • "Transaction" — any purchase, sale, lease, or transfer of a property interest facilitated through the Platform.
  • "Content" — text, images, documents, survey plans, and any other materials uploaded or posted by Users.
  • "Verified Listing" — a Listing that has been reviewed and confirmed by E-Land's verification team.

Eligibility

To use the eProperties platform you must:

  • Be at least 18 years of age.
  • Have full legal capacity to enter into binding contracts under Nigerian law.
  • Not be prohibited from using the service under any applicable law or regulation.
  • Provide accurate, current, and complete information during registration and keep it updated.

Businesses and organisations may register a corporate account provided they have the legal authority to bind the entity to these Terms. Individuals acting on behalf of a company represent that they have the authority to do so.

User Accounts

You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. You must:

  • Choose a strong, unique password and not share it with any third party.
  • Notify E-Land immediately at security@eland.ng of any suspected unauthorised access.
  • Not create multiple accounts or register using false identity information.
  • Ensure your account information remains accurate and up-to-date at all times.
E-Land will never ask for your password via email, phone call, or chat. If you receive such a request, treat it as fraudulent and report it to us immediately.

Platform Use

The Platform is provided to facilitate land and property searches, listings, and transactions in Nigeria. You may use the Platform only for lawful purposes and in accordance with these Terms. All use must comply with applicable Nigerian federal and state laws, including the Land Use Act of 1978 and the Nigeria Data Protection Act 2023.

E-Land acts as an intermediary marketplace and is not a party to any Transaction between Users. We do not hold title to any land or property listed on the Platform.

Listings & Transactions

Users who post Listings represent and warrant that:

  • They hold legal title or are duly authorised to advertise the property.
  • All information provided — including price, location, survey plans, and title documents — is accurate and not misleading.
  • The property is free from undisclosed encumbrances, disputes, or government acquisition at the time of listing.
  • Uploaded documents are genuine and have not been altered or forged.
E-Land reserves the right to verify any Listing at any time. Listings found to be fraudulent, inaccurate, or in violation of these Terms will be removed and the account suspended or permanently banned.

Buyers are strongly advised to conduct independent due diligence, engage a licensed Nigerian surveyor, and consult a qualified solicitor before completing any Transaction.

Fees & Payments

Certain features of the Platform — including premium listings, verification services, and subscription plans — are subject to fees. All fees are displayed in Nigerian Naira (₦) inclusive of any applicable taxes.

  • Payments are processed through our certified payment partners in accordance with CBN regulations.
  • Subscription fees are billed in advance on a monthly or annual basis as selected.
  • Refunds are subject to our Refund Policy, available at /refund-policy.
  • E-Land reserves the right to change fee structures with 30 days' written notice.
  • Transaction escrow services, where offered, are governed by a separate Escrow Agreement.

Prohibited Conduct

You must not use the Platform to:

  • Post fraudulent, misleading, or fictitious land listings.
  • Impersonate another person, organisation, or government authority.
  • Upload forged or altered title documents, survey plans, or identity documents.
  • Engage in money laundering, land racketeering, or any criminal activity.
  • Harvest other Users' contact details for unsolicited marketing.
  • Attempt to gain unauthorised access to the Platform or another User's account.
  • Introduce malware, viruses, or disruptive code to the Platform.
  • Circumvent, disable, or interfere with security or access-control features.
  • Scrape, crawl, or systematically extract Platform data without written consent.
Violations will result in immediate account suspension and may be referred to the Nigerian Police Force, the Economic and Financial Crimes Commission (EFCC), or other relevant authorities.

Intellectual Property

All intellectual property in the Platform — including its design, source code, trademarks, logos, and original content — is owned by or licensed to E-Land Ltd. and is protected under Nigerian copyright and intellectual property law.

By submitting Content to the Platform, you grant E-Land a non-exclusive, royalty-free, worldwide licence to host, display, and use that Content solely to operate and improve the Platform. You retain ownership of your Content and may request its deletion subject to legal retention obligations.

Disclaimers

The Platform is provided on an "as is" and "as available" basis. E-Land makes no warranties, express or implied, including but not limited to:

  • The accuracy, completeness, or reliability of any Listing or User-submitted Content.
  • The legal validity of any title document or survey plan uploaded by a User.
  • Uninterrupted, error-free, or secure operation of the Platform at all times.
  • That the Platform will be free from viruses or other harmful components.

E-Land is a technology facilitator, not a real estate agent, legal adviser, or financial adviser. Nothing on the Platform constitutes professional legal or financial advice.

Limitation of Liability

To the maximum extent permitted by applicable Nigerian law, E-Land Ltd. and its officers, directors, employees, and agents shall not be liable for:

  • Any direct, indirect, incidental, special, or consequential loss arising from your use of the Platform.
  • Land fraud, double-selling, or title disputes arising from User-posted Listings.
  • Loss of data, revenue, goodwill, or business opportunity.
  • Actions or omissions of third parties, including payment processors and verification partners.
In any event, E-Land's total aggregate liability to you shall not exceed the amount you paid to E-Land in the twelve (12) months preceding the event giving rise to the claim.

Termination

You may close your account at any time by visiting your account settings or contacting us at support@eland.ng. Closure does not entitle you to a refund of any prepaid fees.

E-Land may suspend or permanently terminate your access to the Platform, without prior notice, if you:

  • Breach any provision of these Terms.
  • Provide false or fraudulent information.
  • Engage in conduct that is harmful to other Users, E-Land, or third parties.
  • Fail to pay outstanding fees after reasonable notice.

Upon termination, your right to use the Platform ceases immediately. Provisions of these Terms that by nature should survive — including intellectual property, disclaimers, and liability clauses — will continue to apply.

Governing Law & Dispute Resolution

These Terms are governed by and construed in accordance with the laws of the Federal Republic of Nigeria. Any dispute arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of Lagos State, Nigeria.

Before commencing formal proceedings, both parties agree to attempt resolution through good-faith negotiation for a period of no less than 30 days. Where negotiation fails, disputes may be referred to mediation under the Lagos Court of Arbitration rules before litigation.
